This is a translation. The Dutch original at algemene-voorwaarden is the version that binds; where the two differ, the Dutch text prevails.

These terms and conditions apply to all hotels named on amadihotels.com and to reservations made through amadihotels.com, the hotel website, by e-mail, by telephone or through third parties.

Article 1. Definitions

In these terms and conditions, and in all offers, agreements or the formation of agreements to which they apply, the following terms mean:

  • 1.1. Hotel: the accommodation business to which these conditions apply.
  • 1.2. Services: the accommodation the hotel provides, together with all associated work and services.
  • 1.3. Guest: the person to whom the hotel must provide the services under an agreement concluded through an intermediary. References to the guest also cover anyone accompanying the guest. Unless expressly stated otherwise, “guest” and “customer” both cover the guest and the customer.
  • 1.4. Intermediary: the natural or legal person who has concluded an agreement with the hotel for the provision of services. This also covers a person who has concluded such an agreement whether or not in the name of their own relations. A natural person not acting in the course of a profession or business is also called a guest in these conditions.
  • 1.5. Hotel agreement: the agreement between the hotel and the intermediary or guest under which the hotel provides services for that intermediary and/or guest against payment. References to the hotel agreement also cover any other agreement to which these conditions have been declared applicable. These conditions also apply to guests who entered into a hotel agreement through a third party. Reservations made through a third party may carry different conditions.
  • 1.6. Online reservation: the reservation made using the reservation form available on the hotel’s website (the hotel website and amadihotels.com) in order to conclude a hotel agreement. Online reservations made through a third party may carry different conditions.
  • 1.7. Reservation: the hotel agreement entered into in writing by the guest or intermediary and the hotel, recording the period and the conditions under which the hotel agreement will be performed.

Article 2. Applicability of these conditions

  • 2.1. These terms and conditions apply to all offers, agreements and formations of agreements with the hotel.
  • 2.2. Offers, agreements or formations of agreements that depart from these conditions are valid only if expressly agreed with the hotel in writing. Any such departure applies only to that specific hotel agreement.
  • 2.3. Unless the guest or intermediary has told the hotel otherwise in advance, expressly and in writing, the guest, intermediary or any other (legal) person agrees to these terms and conditions.

Article 3. Formation of the agreement

  • 3.1. All offers and quotations from the hotel are without obligation and in any event apply only in so far as the hotel’s capacity is sufficient. An online reservation is taken to show the most current offer possible.
  • 3.2. If the guest or intermediary has accepted an offer and the hotel’s capacity turns out to be insufficient, the hotel may still rely on article 3.1 and change or cancel the agreement, within 48 hours of receiving the reservation, or within one day before the first night, or later where this could not reasonably be expected of the hotel. A solution will first be sought in line with article 4.4 on changes.
  • 3.3. A reservation is final only once the hotel has confirmed it in writing by e-mail. The exception is a reservation made by telephone on the day of arrival, in which case the verbal reservation is final.
  • 3.4. For an online reservation the agreement is formed when the guest or intermediary accepts the offer by entering their details and submitting the reservation form. The hotel will send a confirmation e-mail. Without confirmation or payment by the guest or intermediary, the guest or intermediary may always rescind the agreement — this departs from article 3.3. If the confirmation does not arrive, it is the guest’s or intermediary’s own responsibility to contact the hotel.
  • 3.5. It is the responsibility of the guest or intermediary to supply the hotel with correct details, including name, e-mail address, telephone number and the number of guests (adults and children). The guest must notify the hotel of any changes. By supplying these details the guest consents to the hotel making contact about the reservation.
  • 3.6. For a reservation made by telephone, the guest receives the confirmation e-mail within one hour during office hours. For a reservation made by e-mail, the guest receives it within twelve hours of confirming the quotation. If it does not arrive, it is the guest’s own responsibility to contact the hotel.
  • 3.7. Every agreement entered into by an intermediary is deemed to have been concluded at that intermediary’s expense and risk as well. Any payment by a guest discharges the intermediary to the same extent.
  • 3.8. Unless expressly agreed in writing, the hotel owes an intermediary no commission or fee of any kind.
  • 3.9. The hotel may let an (online) reservation lapse if a guest has not presented themselves by 12:00 on the first reserved day after the first night and has not informed the hotel in time about the delay. The payment obligation remains as previously agreed.
  • 3.10. If the arrival and/or departure date changes, the original final reservation lapses and a new final reservation is formed by mutual agreement. Prices and conditions may differ from the original reservation.
  • 3.11. The hotel compiles the information on the website with the greatest care; even so, inaccuracies or incompleteness may occur through data transfer, technical faults or other circumstances. Room descriptions and photographs may differ in reality and are given as examples only. All online reservations are subject to obvious changes and errors. Changes in the VAT rate, the tourist tax or any other legally required tax are always passed on to the guest. The tourist tax may change between booking and stay. Where this applies, the hotel will inform the guest or intermediary.
  • 3.12. Guest name changes are accepted only if the intermediary submits them through their own system. For reservations made directly with the hotel, the guest must submit the name change in writing.
  • 3.13. Guests must be 18 or over to stay at the hotel, or must be accompanied in the same room by a person of 18 or over.
  • 3.14. If a guest needs a visa in order to stay at the hotel, the hotel bears no responsibility for it. On request, the hotel can send a visa confirmation by e-mail. This requires full advance payment of the first night by payment link. That payment is non-refundable; no refund is given in the event of cancellation. The hotel bears no responsibility for whether a visa is granted.
  • 3.15. The hotel accepts no reservations without a valid credit card, unless the non-refundable rate has been booked and/or paid in full in advance. The cardholder and the credit card must be present at the hotel on arrival. If the guest does not hold a valid credit card, the hotel may cancel the reservation.
  • 3.16. The hotel charges tourist tax to all hotel guests and makes no distinction between residents of Amsterdam and guests from outside the city. Residents of Amsterdam must also pay tourist tax when staying at one of our hotels.

Article 4. Obligations of the hotel

  • 4.1. The hotel will make the agreed accommodation available to the guest for the agreed period and/or provide the agreed services, in line with the quality standards that apply within the hotel.
  • 4.2. Article 4.1 does not apply if: a. there is force majeure as described in the article on force majeure (article 9); b. the guest does not appear, or appears more than half an hour late, after the agreed deadline or the deadline named in article 3.10; c. the advance or interim payments referred to in article 7 have not been paid, or not paid on time, by the intermediary or guest; d. the intermediary does not fully meet its obligations towards the hotel; e. the guest has chosen to pay on arrival and does not hold a valid credit card in their own name; f. the guest does not observe the house rules.
  • 4.3. Unless agreed otherwise in writing, the hotel will make the accommodation available to the guest from 15:00 on the day of arrival until 12:00 on the day of departure.
  • 4.4. The hotel may offer the guest accommodation other than that which would be made available under the hotel agreement. Where the accommodation offered and accepted is cheaper than the original, the hotel will make the difference available to the guest or intermediary. The hotel is in no case liable for any further compensation.

Article 5. Group reservations

  • 5.1. From six rooms, a reservation counts as a group reservation. The provisions for individual reservations also apply to group reservations. Where provisions conflict, this article prevails.
  • 5.2. An intermediary or guest may make an optional reservation for a group. An optional reservation is formed only once the hotel has confirmed it in writing, and may be held until the agreed date. Unless expressly agreed in writing, an optional reservation lapses automatically at 12:00 noon.
  • 5.3. A final reservation is formed only once the hotel has confirmed it in writing and the deposit has been received. If the arrival and/or departure date changes, the original final reservation lapses and, by mutual agreement and subject to availability, the new final reservation is moved to the dates requested. If availability does not allow this, the cancellation conditions apply (article 5.6).
  • 5.4. For a group reservation, a guest or intermediary may reduce the number of rooms by a maximum of two at no cost up to two weeks before arrival, unless agreed otherwise.
  • 5.5. Increasing the number of rooms originally reserved is possible only in consultation with the hotel. The hotel is in no way responsible for increases made without consultation.
  • 5.6. On full cancellation of a final reservation up to eight weeks before arrival, no charge is made, other than the non-refundable deposit paid on confirmation of the group reservation. Eight weeks before arrival, 50 % of the total reservation value must be paid. Free cancellation is no longer possible once that payment has been received. On full cancellation of a final reservation less than four weeks before the arrival date, the guest or intermediary must pay the hotel 100 % on the basis of accommodation, breakfast and any group dinners reserved. The guest or intermediary ensures that the hotel has the guest list no later than seven working days before the arrival date.
  • 5.7. If the guest or intermediary fails to meet the preceding articles, the hotel treats the final reservation as cancelled. That cancellation is treated as the cancellation of a final reservation (article 5.6). The guest or intermediary receives no refund of amounts already paid. Where a part payment has been received, the guest or intermediary is entitled only to the number of rooms equal to the value of that payment.
  • 5.8. The hotels accept no youth groups. These are groups in which more than 30 % of the participants are under 22.

Article 6. Cancellation

  • 6.1. Where the reservation was made through a third party (an (online) travel agent or booking website), other conditions may apply.
  • 6.2. A hotel agreement is irrevocable and cannot be cancelled, unless the conditions provide otherwise.
  • 6.3. Specifically for online reservations, consumers have no right of withdrawal, in accordance with article 6:230p of the Dutch Civil Code. Dutch law applies to all agreements, however named, including where the guest or intermediary resides outside the Netherlands.
  • 6.4. Where the hotel’s website states a specific cancellation rule, that rule is a fixed part of the offer and takes precedence over the irrevocability set out in this article. The guest may then cancel as stated on the reservation confirmation, where the conditions allow it.
  • 6.5. Once the guest has checked in, free cancellation is no longer possible. There is no refund of costs already paid. This also covers all facilities and services booked in addition, such as breakfast and extras (rose petals, among others).
  • 6.6. Cancellation must be made in writing — including online through the form provided on the website — by e-mail, and must be dated.
  • 6.7. Unless it is a group reservation (article 5), unless agreed otherwise in writing, and unless the reservation was made through an intermediary or third party, a reservation may be cancelled free of charge until 12:00 on the day before arrival.
  • 6.8. In the event of the cancellation of a non-refundable reservation, the hotel gives no refund in any circumstances.

Article 7. Room rates and payment

  • 7.1. Prices may vary by type of accommodation, day, time of booking, rate type, payment conditions and cancellation conditions.
  • 7.2. The guest or intermediary owes the hotel the amounts stated in the hotel agreement. The hotel may charge the guest and/or intermediary extra for particular services such as use of the car park, the telephone or the remittance of tourist tax. Costs are communicated clearly.
  • 7.3. All bills, including any bill for cancellation or no-show, must be settled by the guest and/or intermediary before or on arrival. The place of payment is the hotel location to which the invoice relates.
  • 7.4. The intermediary is deemed to conclude the hotel agreement, or any other agreement, on behalf of each of its guests as well. By appearing, the guest indicates that the intermediary was authorised to represent them.
  • 7.5. Payment is made in euros, by Mastercard/VISA/AMEX or debit/iDEAL/Maestro/PIN/payment link. Where the hotel accepts payment in foreign currency, the market rate applying at that moment is used. In that case the hotel may charge administration costs of up to 10 % of the amount in foreign currency. Global Blue Currency Choice — best price guarantee: when paying by credit card the guest is offered the option to pay in their own currency. Should the guest experience a negative exchange difference, a complaint can be made by e-mailing [email protected] and requesting a claim form. The request must be made within 60 days of the transaction. The hotel is not responsible for exchange rate differences.
  • 7.6. The hotel may refuse cheques, cash euros and other similar means of payment, or any means of payment other than those named above. It is otherwise for the hotel to decide which payment methods are offered. For an online reservation the payment options are communicated in good time before the agreement is concluded. The hotel may require payment in advance, in whole or in part; this applies to all types of reservation and is ultimately set off against the amount finally payable. In the event of free cancellation, the amount already paid is refunded as soon as possible. Refunds, whole or partial, are made to the same means of payment used before.
  • 7.7. The hotel accepts no reservations without a valid credit card, unless the non-refundable rate has been booked and paid in full at least 48 hours before arrival, and/or the flexible rate has been booked and paid in full at least 24 hours before arrival. The cardholder and the credit card must be present at the hotel on arrival. If the guest does not hold a valid credit card, a payment link can be sent. If payment does not follow, the hotel may cancel the reservation.
  • 7.8. If the guest uses services in the hotel during their stay (article 7.2), the hotel may demand payment for those services.
  • 7.9. If the guest or intermediary does not meet their payment obligation in time, then — after the hotel has pointed out the late payment and allowed a period of 14 days to comply — statutory interest becomes due on the outstanding amount once that 14-day period has passed without payment. The hotel may charge its extrajudicial collection costs. These amount to at most (with a minimum of € 40): 15 % on outstanding amounts up to € 2,500, 10 % on the next € 2,500 and 5 % on the following € 5,000. The hotel may depart from these amounts and percentages in the guest’s or intermediary’s favour.
  • 7.10. If a guest or intermediary requests an invoice for a past reservation, or asks for changes to an invoice, the hotel may charge € 25.00 in administration costs per invoice.
  • 7.11. It is the guest’s or intermediary’s own responsibility to book for the number of people (adults and children) actually staying at the hotel and/or using services. If the booking is for fewer people than are present, the hotel may charge the shortfall in tourist tax and/or services.
  • 7.12. For a booking on a flexible rate with payment on arrival, the credit card provided for the booking must belong to the guest and must be shown at check-in. Check-in is not accepted if the guest and the cardholder are not present. On arrival the hotel reserves the right to compare the card number used for the booking with the actual credit card. If the cardholder is not present, or the card does not belong to the guest, the hotel reserves the right to cancel the booking. Where a payment link was sent at the time of booking, payment must be settled by the time the reservation deadline expires.

Article 8. Stay

  • 8.1 All guests entering the hotel must report to reception to be registered.
  • 8.2 Smoking is strictly forbidden in all hotels. In the event of a breach the hotel will impose a fine of € 150 on the guest, and the guest must leave the hotel without a refund of costs already paid. If the guest disables the smoke detector and thereby endangers the whole hotel, the hotel will impose a fine of € 150 and the guest must leave without a refund of costs already paid.
  • 8.3 Pets are not permitted in the hotels. The hotel may cancel the reservation without refunding room costs already paid if guests attempt to check in with pets.

Article 9. Liability

  • 9.1 This article applies only where the guest or intermediary is a (legal) person acting in the course of a profession or business. Where the customer is a consumer, the hotel’s liability is limited only so far as the law allows.
  • 9.2 Unless there is intent or gross negligence on the hotel’s part, the hotel accepts no liability of any kind.
  • 9.3 Unless there is intent or gross negligence on the hotel’s part, the hotel accepts no liability for damage to, or caused with, the guest’s vehicles.
  • 9.4 Unless there is intent or gross negligence on the hotel’s part, the hotel accepts no liability for damage arising directly or indirectly, to whomever or whatever, as a direct or indirect result of any defect in, on or to any movable or immovable property that the hotel owns, leases or rents, or that is otherwise at the hotel’s disposal.
  • 9.5 The hotel’s liability will never exceed the value of the hotel agreement, or the compensation covered by the hotel’s insurer, or the damages paid to the hotel by any other third party.
  • 9.6 The guest or intermediary fully indemnifies the hotel against any claim, however named, that a guest and/or any third party brings or may bring against the hotel in respect of claims, in the broadest sense, arising from the hotel agreement concluded with the guest or intermediary or from any other agreement. This indemnity also applies to the hotel agreement where it has been dissolved in whole or in part for any reason.
  • 9.7 The hotel is not responsible for belongings brought into or around the hotel and the car park. Those belongings are brought at the guest’s own risk. The hotel cannot be held responsible for damage to or loss of the guest’s belongings, including where they are left behind, lost or damaged before, during or after the stay.

Article 10. Force majeure

  • 10.1 Force majeure includes: illness among staff that makes operating the business reasonably impossible, war, failing equipment, the threat of war, riot, strike or occupation of the premises, water damage, molestation, terrorism, fire, flood, natural disaster (such as tsunami or volcanic eruption) or government measures that make operating the business reasonably impossible.
  • 10.2 In the event of force majeure the hotel may either cancel or suspend the agreement. In that case the hotel is under no obligation to compensate any damage. In the event of the cancellation of a non-refundable reservation, the hotel gives no refund in any circumstances.
  • 10.3 The above applies equally where the force majeure occurs at persons, services or institutions the hotel uses in performing the hotel agreement or any other agreement. This also covers anything arising at those persons, services or institutions as a suspensive or resolutive condition, or their failure to perform. The hotel is not required to demonstrate the effect of this on its business.

Article 11. Warranty and conformity

  • 11.1 The hotel warrants that the services meet the agreement, the specifications stated in the offer, the reasonable requirements of soundness and usability, and the statutory provisions and government regulations in force on the date the agreement was formed.
  • 11.2 If the service delivered does not conform to the agreement, the guest must notify the hotel within a reasonable period after discovering the defect. This means in any event both during the stay and no later than 14 days after using the service. It is the guest’s responsibility to show that the defect was reported during the stay.
  • 11.3 If the hotel considers the complaint justified, the relevant products are repaired, replaced or refunded in whole or in part after consultation with the guest or intermediary, where repair or replacement proves impossible. The maximum compensation equals the price paid by the guest or intermediary for the product.

Article 12. Complaints procedure

  • 12.1 If the guest has a complaint about a product or about any other aspect of the hotel’s service, they may submit it to the hotel by e-mail during the stay, at [email protected] or +31 (0) 20 2626900.
  • 12.2 A complaint sent by e-mail is forwarded to the hotel concerned with a request to deal with it. Complaints after departure are dealt with only if you demonstrably informed us during your stay.
  • 12.3 Any complaint against the hotel or relating to the hotel must be submitted as soon as possible, and in any event within 14 days of the planned day of use of the product or service (for example the check-out date). Any claim or complaint submitted after those 14 days may be refused, and the guest will lose the right to any compensation.
  • 12.4 The hotel responds to the complaint as soon as possible, and in any event within five working days of receiving it. If a substantive or final response is not yet possible, the hotel will confirm receipt within five working days and indicate when it expects to respond substantively.

Article 13. Applicable law and disputes

  • 13.1 Dutch law applies to all agreements, however named, including where the guest or intermediary resides outside the Netherlands.
  • 13.2 Subject to the above, and unless mandatory provisions prevent it (as with consumer disputes), all disputes arising from an agreement to which these conditions apply in whole or in part will be settled by the district court in Amsterdam.

House rules

To keep the atmosphere pleasant for everyone, we expect our guests to observe the following house rules:

  • Using, possessing or dealing in drugs (including but not limited to marijuana, GHB, cocaine, hashish, weed, LSD and XTC) and other illegal goods in and around the building is not permitted.
  • Using, dealing in or bringing nitrous oxide during your stay at our hotel is not permitted.
  • The hotel has the right to ask a guest to open and show their luggage.
  • Carrying a weapon of any kind is strictly forbidden.
  • Unwanted behaviour towards staff and/or other guests — including unwanted advances, racism, discrimination and aggression — is not tolerated.
  • Unwanted or offensive behaviour in or around the building, including prostitution, is not tolerated.
  • Taking photographs, sound recordings or film of hotel staff without written permission is not permitted.
  • Hotel property may not be taken out of the building under any circumstances.
  • If you damage the property of our hotels, you are held liable for the cost of repair or replacement.
  • The hotel is not liable for the loss of or damage to your personal belongings.
  • Causing a nuisance, including noise, in or around the building is strictly forbidden.
  • Cameras are present in and around the building. By entering the building and its immediate surroundings you consent to recordings being made of you.
  • Staff may refuse anyone entry or ask them to leave the premises at any time.
  • Instructions from staff must be followed at all times.
  • You must show identification at the request of staff.
  • By order of the municipality, staying in the hotel without a valid room reservation is not permitted.
  • Renting the room in your name without staying in it yourself is not permitted.
  • Staying in the room with more than the reserved number of people is not permitted.
  • Receiving visitors in the room is not permitted, however short the visit.
  • Smoking anywhere in the building, including the car park where there is one, is strictly forbidden. This also applies to electronic cigarettes.
  • If you disable the smoke detector and thereby endanger the whole hotel, the hotel will impose a fine of € 150.00.
  • If the fire alarm goes off because of smoking in the room, the fire brigade’s call-out cost of € 150.00 will be charged to you.
  • Cooking in the room and using a (camping) gas stove are not permitted. Burning incense or candles in the room is not permitted either.
  • Using the emergency exits as ordinary entrances and exits is not permitted.
  • The room is cleaned at least every three days, including where you have set the room panel or the door hanger to “Do not disturb”.
  • If the room is left unreasonably dirty, extra cleaning costs of € 50.00 may be charged.
  • Found items can be handed in at reception.

We operate a zero-tolerance policy. This means that if these house rules are not observed, no warning will be given and you will be asked to leave the hotel immediately, without a refund of room costs already paid.
